The first tie-breaker was a translation error by the US translator. This has been admitted by him in this forum. So, the Winner is the player with the MOST empty Spaces.

The second tie-breaker is the same in both the German and English rules: the Winner among the tied players is the one LATER in the turn order. This is confirmed by the game editor, Stefan Brück (alea), who has written the original rules.

This came up during game #36934 on BoiteAJeux.net (an excellent implementation of the game, btw!). In that case, the win was given to the player who went later in turn order at the end of the game (who was the player who went first at the beginning).
This is the correct way. It doesn't matter who started the game. This is not meant to be a memory game. The relevant issue, is the player order during the final round - and here the advantage goes to the later player, who will be at a disadvantage when making choices.
